Judge Refuses To Dismiss Rape Charges Against Harvey Weinstein Who Is Facing Life In Prison As Criminal Case Proceeds

December 20. 2018

Harvey Weinstein in criminal court

New York Judge James M. Burke has ruled the rape trial of disgraced former movie producer, Harvey Weinstein, will proceed. Weinstein’s defense attorney, Benjamin Brafman, attempted to have all the charges dismissed, but failed to do so, after cockily stating the case would be thrown out (1 Of 6 Charges Against Harvey Weinstein Dropped But He Is Still Facing Life In Prison).

In October, Branfman got one of the charges dismissed, but five remained. Judge Burke’s ruling has come as a big blow to Weinstein, who was confident the charges would be tossed. Weinstein is facing life in prison, his film company has been auctioned off and dismantled, his wife has left him and most of his fortune is gone. However, he gets no sympathy from me regarding his current plight, as he deliberately and viciously destroyed many careers in the entertainment industry, leaving people destitute. It's high time he gets a dose of his own medicine (which has been happening since his massive fall from grace).

Branfman has been presenting emails claiming some of Weinstein's accusers had pleasant things to state about him after the alleged rapes. Branfman and Weinstein are trying to paint the picture the sex was consensual, despite the fact the women stated it was rape and sexual assault. Despite the fact there exists taped evidence of Weinstein sexually assaulting a model. Despite the fact his own former employees are stating they faced horrible sexual harassment, sexual assault and other abuses (Harvey Weinstein Sued By The State Of New York Attorney General For Committing Civil Rights Violations).

Here’s the problem with Branfman and Weinstein’s claims, regarding victims being cordial with him after he violated them. Many sexual assault victims are terrified of the person who sexually assaulted or raped them, and do not want upset their victimizer for fear of further crimes being committed against them. Some victims of sexual assault and rape suffer from Stockholm Syndrome, regarding people who are so abused they begin to outwardly show sympathy for their abusers in trying to survive a horrible situation.

A prime example is Jaycee Dugard. On June 10, 1991, 11-year-old Dugard was kidnapped on the way to the bus stop by pedophile and convicted sex offender Phillip Garrido. He kept her in a filthy shed behind his house and sexually abused her for years, even impregnating her twice. She stated the mental and sexual abuse was terrible.

After 20-years of rape, sexual assault, mental and physical abuse, there were chances for her to run away, but she did not for a little, as she did not know what to do and how to get her young daughters away from deranged Garrido. However, one day she summoned the courage to flee with her two children.

Therefore, a victim not showing outward hostility towards a rapist does not mean the person was not raped. Not to mention, Weinstein is a violent, vindictive man, who has spent millions of dollars to employ private investigators and thugs to stalk, spy on and harass his victims, whose privacy he has criminally violated, in bids at exploiting, controlling and bullying them into silence.

Weinstein threatened to harm people, even using his ties to high profile Democrats such as Barack Obama, Michelle Obama and Hillary Clinton, to threaten people, stating he has connections and would send the U.S. Secret Service after them (Barack Obama, Michelle Obama And Hillary Clinton Slammed For Their 'No Comment' On Harvey Weinstein Finally Issues Statements). He was one of the most feared men in Hollywood, known for loudly screaming at and threatening people, especially women. Weinstein is a psychopath, who has harmed many people. He must pay for his crimes against others, within the confines of the law, by being imprisoned.
